Acceptable Use Policy | SendSeven

Guidelines for acceptable use of SendSeven's messaging platform. Prohibited activities, compliance requirements, messaging policies, and usage limits.

This Acceptable Use Policy ("AUP") governs your use of SendSeven's messaging API platform (the "Service"). By using our Service, you agree to comply with this policy. Violations may result in immediate suspension or termination of your account without prior notice.

You may not use SendSeven to send, receive, store, or transmit any of the following content:

Unsolicited bulk email or messages (spam)

Messages to recipients who have not explicitly opted in

Messages to purchased, rented, or scraped email/contact lists

Messages that violate CAN-SPAM Act, GDPR, or similar anti-spam regulations

Messages with misleading or deceptive subject lines or sender information

1.2 Fraud, Phishing, and Deceptive Content

Financial scams, pyramid schemes, or multi-level marketing fraud

Deceptive pricing or misleading product claims

Fake news, misinformation, or deliberately false content

Hate speech, discrimination, or content promoting violence against individuals or groups

Harassment, threats, stalking, or bullying

Defamatory, libelous, or slanderous content

Content that violates privacy rights or discloses personal information without consent

Content promoting or facilitating illegal drugs, controlled substances, or drug paraphernalia

Illegal weapons, explosives, or instructions for creating weapons

Content related to illegal gambling or unregulated financial services

Counterfeit goods or intellectual property infringement

Content that violates export control laws

Adult content, pornography, or sexually explicit materials (unless you have explicit written permission from SendSeven)

Child sexual abuse material (CSAM) or content exploiting minors

Viruses, malware, trojans, ransomware, or other malicious code

Scripts or code designed to exploit vulnerabilities

You may not use SendSeven to engage in the following activities:

Purchasing, renting, or scraping email addresses or phone numbers

Sending messages without proper documented consent (opt-in)

Harvesting contacts from social media or other platforms without authorization

Failing to honor unsubscribe requests within 24 hours

Attempting to bypass or circumvent security measures

Attempting to gain unauthorized access to our systems, networks, or other accounts

Probing, scanning, or testing vulnerabilities without explicit written permission

Sharing API keys or credentials with unauthorized parties

Distributed denial-of-service (DDoS) attacks or similar activities

Excessive API calls designed to overload our infrastructure

Operating open mail relays or open proxies

Interfering with other customers' use of the Service

2.4 Regulatory and Compliance Violations

Violating the CAN-SPAM Act (US), GDPR (EU), CASL (Canada), or similar regulations

Violating TCPA (Telephone Consumer Protection Act) for SMS messages

Failing to provide required identification, unsubscribe mechanisms, or physical addresses

Sending messages during prohibited hours or to numbers on do-not-call lists

Activities that damage SendSeven's reputation or sender reputation

Causing our IP addresses or domains to be blacklisted

High bounce rates, complaint rates, or unsubscribe rates

All messages sent through SendSeven must be to recipients who have provided explicit consent:

Documented Opt-In: You must maintain records of how and when recipients opted in

Clear Expectations: Recipients must know what type of messages they'll receive

Easy Unsubscribe: Every message must include a clear, functional unsubscribe mechanism

Honor Opt-Outs: Unsubscribe requests must be processed within 24 hours

Accurate Sender Info: "From" name and email address must be accurate and not misleading

4. Compliance with Third-Party Platform Policies

When you connect a messaging channel to SendSeven, you agree to comply with the respective platform's own policies and terms of service, in addition to this Acceptable Use Policy. Violating a platform's policies may result in that platform restricting, suspending, or banning your account or number, independent of any action taken by SendSeven, and may also constitute a violation of this policy subject to the enforcement measures described in Section 5.

There is no single platform policy for email. However, all email messages sent through SendSeven must comply with applicable anti-spam laws, such as the GDPR/ePrivacy Directive and the CAN-SPAM Act, as well as the consent requirements set out in Section 3 of this policy.

All SMS messages sent through SendSeven must comply with applicable telecommunications and anti-spam regulations in the recipient's country, as well as the consent requirements set out in Section 3 of this policy.

Third-party platform policies are subject to change at any time and without notice to SendSeven. You are responsible for staying informed of and complying with the current policies of each platform you use.

We use automated systems to monitor content and activity on our platform, including:

Bounce rate and complaint rate monitoring

Anomaly detection for unusual sending patterns

Campaigns flagged as suspicious may be held for manual review by our compliance team. We reserve the right to review message content, sender practices, and opt-in documentation at any time.
